Opposition from the Tri-Nikaya Mahanayake Theros and Unsuccessful Ministerial Efforts Against the Judicial Retirement Age Amendment

A significant controversy has arisen in the country regarding the government’s proposed constitutional amendment to extend the retirement age of judges.

The key points regarding this issue are summarized below:

• Letter to the President from the Tri-Nikaya Mahanayake Theros: The Mahanayake Theros of the Malwatta, Asgiriya, Ramanna, and Amarapura chapters have sent a joint letter to the President stating that the constitutional amendment to extend the judges’ retirement age is inappropriate. This was revealed to Sri Lanka Bar Association (BASL) President Rajeev Amarasuriya by the Mahanayake Thero of the Malwatta Chapter.

• Failure of the Minister of Justice’s Efforts: Although the Minister of Justice previously met with the Tri-Nikaya Mahanayake Theros to explain the reasons behind the proposal and present their side, their explanations and efforts yielded no positive result or approval from the prelates.

• Direct Opposition: Despite the Minister’s explanations, the Mahanayake Theros have officially and strongly expressed their opposition to the proposed constitutional amendment.

• Stance of the Bar Association: Amidst the strong opposition from the Mahanayake Theros and the Judicial Service Association, BASL President Rajeev Amarasuriya emphasized that the current government has no moral right to push forward with this constitutional amendment.
